Assumption of Risks, Release, Waiver, and Indemnity Agreement

By entering the premises of the Electric Love Music Festival (the “Festival”), held at the Meadows of Cel7wet Festival Grounds in Pritchard, BC, on the traditional, ancestral, and unceded territory of the Secwépemc people, you acknowledge and agree to the following terms:

Assumption of Risks

I acknowledge and agree that I am entering the premises to attend the Festival and that certain risks, dangers, and hazards are inherent in participating in outdoor events. These include, but are not limited to:

  • Inclement or changing weather conditions;

  • Proximity to the Thompson River, which poses risks due to strong currents and unpredictable conditions (entering the water is strongly advised against and entirely at my own risk);

  • Wildlife;

  • Negligence of other attendees; and

  • Any negligence on the part of Electric Love Music Festival (a division of Myden Enterprises Inc.), its employees, or contractors in safeguarding or protecting me from these risks.

I freely accept and fully assume all such risks, dangers, and hazards, including the possibility of personal injury, illness, death, property damage, or loss resulting from these risks, whether caused by myself, other attendees, or the Festival organizers.

Release of Liability, Waiver of Claims, and Indemnity Agreement

In consideration of being permitted to enter and participate in the Festival, I agree to the following:

  1. To waive any and all claims that I have or may have in the future against Electric Love Music Festival (a division of Myden Enterprises Inc.), its directors, officers, employees, contractors, representatives, successors, assigns, property owners, and the Meadows of Cel7wet Festival Grounds (collectively, the “Releasees”).

  2. To release the Releasees from any and all liability for loss, damage, expense, harm, or injury, including death, that I or my next of kin may suffer, resulting from my use of or presence on the premises or travel to or from the Festival, due to any cause whatsoever, including negligence, breach of contract, or breach of any statutory or other duty of care, including any duty of care owed under the Occupiers Liability Act, RSBC 1996, C.337, on the part of the Releasees, and also including any failure on the part of the Releasees to safeguard or protect me from any risks, dangers, or hazards referred to above.

  3. To hold harmless and indemnify the Releasees from any loss, liability, damage, or cost arising from my actions, omissions, or presence on the premises, or travel to or from the Festival, including property damage or injury to third parties caused by me.

Terms of Entry

  1. Search Policy: Entry to the premises is contingent upon personal and vehicle searches for prohibited items, including but not limited to illegal drugs, weapons, outside alcohol, glass, and other hazardous materials. If prohibited items are found, they will be confiscated, and my entry will be revoked without refund.

  2. Zero Tolerance Policy: Illegal drugs, weapons, and improperly used prescription or over-the-counter medications are strictly prohibited. Prescription medications must include valid documentation and be in the required dosage for the duration of the event.

  3. Consent to Filming: By attending the Festival, I grant Electric Love Music Festival (a division of Myden Enterprises Inc.) the right to film and photograph the event, including my likeness, and use this footage for promotional purposes without compensation.

  4. Water Safety: I understand that the Thompson River is located near the Festival grounds and poses inherent risks, including strong currents and unpredictable conditions. I agree that entering the water is entirely at my own risk, and I acknowledge that I have been strongly advised against doing so.

Acknowledgment and Governing Law

This Agreement shall be effective and binding upon my heirs, executors, administrators, and representatives in the event of my death or incapacity.

This Agreement and any rights, duties, and obligations as between the parties shall be governed by and interpreted solely in accordance with the laws of the Province of British Columbia, and any litigation shall be exclusively within its courts.

By entering the premises, I confirm that I have read, understood, and voluntarily agreed to these terms.
